SB554 Summary:
Transfer and Storage
- One must be in “Control” of their firearm enough to prevent another person from obtaining it in their own residence and the residence must be locked an secure. When not in direct control the owner, possessor or authorized person must have the firearm secured with a lock, in a locked container, OR in a gun room. Handguns cannot be left in a vehicle and be seen by others outside the vehicle.
- Violations of "control" are Class C violations and if the firearm is obtained by a minor, it is a Class A violation.
- If there is injury or property damage after your firearm is stolen, and you were in violation of the above, this constitutes "per se negligence" and can not be overcome by showing the owner acted responsibly. This does not apply if the firearm was obtained by persons unlawfully entering or removing it from a dwelling. Note this exception does not apply to firearms stolen from your automobile.
- If the firearm is stolen, you have 72 hours to report the crime. If there is no means to report, you have 24 hours once the means become available.
- Minors must be supervised, with the consent of a parent or guardian, except when hunting or target shooting, and this does not apply when the minor owns the firearm.
- Public K-12, colleges, and university school boards may declare policies banning CHL holders from possessing guns on school grounds. This requires a sign and must be posted on their website.
- CHL holders exercise their right to carry in the Oregon Capitol or Portland International Airport (this does not apply to transporting a firearm as a checked bag in accordance with FAA regulations.
- Violations in these areas, by CHL holder, is a Class A misdemeanor
- Your CHL fees just doubled from $50 to $100 and to $75 for renewal.

- Authorizes city, county, metropolitan service district, port operating commercial airport, school district, college or university to adopt ordinance or policy limiting or precluding affirmative defense for possession of firearms in public buildings by concealed handgun licensees.
- Modifies definition of “public building,” for purposes of crime of possession of weapon in public building, to include certain airport areas, buildings owned or controlled by public bodies and real property owned by college or university.
- Punishes violation by maximum of five years’ imprisonment, $125,000 fine, or both.
- Additional Information: Increases fees for concealed carry licenses.
- Now includes lockup bill , see HB2510 which requires locking of firearms unless they are in your direct control in a locked container, with a trigger lock, or in a gun room. establishes if a firearm, that was not secured, is taken the orginal owner is responsible for damages caused by the person that took the firearm.

UPDATE 5/6/21: Yesterday the Oregon Senate passed SB554.
Let’s take the bill by its parts.
The SB554 piece (No firearms in public) means that municipalities can invoke laws to make a patchwork of zones where carrying firearms (even CHL) is unlawful. This means 4 things:
- Law-abiding citizens will be tripped up on a maze of zones and inadvertently become felons as they attempt to travel normally through the state.
- Law-abiding citizens will be forced to stow their firearms in vehicles.
- This bill is completely unenforceable as written – it only impacts law-abiding citizens. Criminal or those with unlawful intent will ignore the law.
- This bill will create zones where personal protection is not allowed and only bad people have firearms.
The HB2510 piece (Lockup and Misplaced Liability Bill) means that one must always have personal control or have their firearms locked in some form. Unfortunately, in also includes misplaced liability for a firearms owner for actions of others 2 years after ownership.
- As noted in prior communications, OSSA advocates for safe storage, if done correctly. OSSA has offered to help with those guidelines but continues to be ignored.
- This bill is unenforceable and only focuses on punishing todays law-abiding citizens, not the criminal use of firearms.
- This means you, law-abiding Oregonians, will be responsible for actions of criminals and unlawful acts of others.

Unfortunately, the shiny ball was too much to resist.! The gun control crowd has executed a deceptive and dishonorable deed on Oregonians. An awfully bad bill (original SB554 - no firearms in public) was combined with a grossly flawed HB2510 (firearms lockup and misplaced liability bill) to pass poor legislation, that cannot be enforced, and will have no effect on unlawful or criminal firearms use.

UPDATE 4/24/21:
- The original scope to redefine public places and limit use of CHL in those places. Including large airports. an attempt is made to enable normal travel throug h airports such as PDX.
- A version of HB2510 (Lockup bill) that does include a gun room as suitable storage location.
- Holds one responsible for liability of the actions of others that have taken your firearm.
- SB554-A36 will create a patchwork of inconsistent ordinances that will inadvertently make felons of law[1]abiding citizens as they pass through a region, state, or town. This will create a maze that will entrap well-meaning law-abiding citizens and turn them into Felons..
There is a work session conducted on friday was not viewable as previously advertized. Aprox 12 ammendments were worked without public review ..
UPDATE 4/23/21: SB554 completed 2 public hearings this week and is scheduled for a work session today. SB554 has become a catch all bill for all of the measures submitted this session.
- The original scope to redefine public places and limit use of CHL in those places. Including large airports. Yes, as written, the bill would enable, that you not be able to travel through PDX with a firearm - and amendment has been posted to try to correct this but it is also flawed. SB554A will create a patchwork of inconsistent ordinances that will inadvertently make felons of law[1]abiding citizens as they pass through a region, state, or town. In addition, the amendment repealing state firearms preemption will create a maze that will entrap well-meaning law-abiding citizens.
- An incomplete version of HB2510 (Lockup bill) that does not allow a gunroom in your house,
- Holds one responsible for liability of the actions of others.
- And most importantly, includes repeal of the state level preemption for firearms. Meaning, local municipalities and non-elected officials can independently adopt ordinances or policy on firearms (possession, use, sale, transfer, storage,...).
OSSA expressed, as responsible firearms owners, we support safe storage for safety – but it needs to be done right and consistent with practical use, maintenance of firearms for sporting and self-defense. SB554 needs to focus on one issue – work that issues with people with practical knowledge – and get that one right.
UPDATE 4/19/21: SB554 is scheduled for a public hearing on 4/21/21 and 4/22/21 this week. Submit your written testimony and register to voice your opposition to this poor legislation. To be clear, this legislation will create an unpredictable patchwork of gun free zones. Law abiding citizens will attempt to continue to be law abiding by stowing their CHL approved firearms in their cars- and this makes our communities safer?
UPDATE 3/26/21: SB554 has been Approved in the Oregon Senate.
- SB554 has been approved by the Oregon Senate through its majority. Unfortunately, the quorum was obtained, and business could be conducted, as denying the quorum was the only path to stopping this poor legislation.
- To be clear, this legislation will create an unpredictable patchwork of gun free zones. Law abiding citizens will attempt to continue to be law abiding by stowing their CHL approved firearms in their cars- and this makes our communities safer?
- The democratic leadership has continued to ignore public comment and input. These politicians are not representing the people, only their interests.
- SB554-A is headed to the House.
UPDATE 2/25/21: SB554 has been voted out of committee and is headed to the floor.
- SB554 been ammended "-10 amendment" proposed to attempt to fix glaring problems but they have only made it worse for public safety. Not only does this bill remove CHL holders from public buildings thus creating gun free zones where history has shown that >95% of criminal mass events occur, it forces law abiding citizens to stow their firearms in vehicles as a matter of practice to avoid from becoming a felon. This is just bad legislation.
- The Senate Majority continues to categorize our law abiding citizens, as extremists, which is just not the case (see the press release). Oregon gun owners, sportsmen, and CHL holders which this bill targets specifically are responsible reasonable and valued parts of our community.
- Unfortunately, the committee chairman is ignoring public testimony with the solid data and is proceeding with the agenda to remove oregon citizen's right to keep and bear arms.
- Your Action is needed!
- Contact your Senators and Representatives to let them know that this legislation needs to stop,

- DECIDE: Conclude what this means for you, your family, and your grandchildren.
- COMMUNICATE:
- You are one of their voters!
- This is bad legislation it makes felons of their most lawful citizens.
- Show your legislators that you are the responsibles citizens they represent.

The testimony was OVERWHELMINGLY in OPPOSITION, however, it is clear that that the committee chair did not hear the constituents and will continue to a work session on Thursday to process 7 amendments to this poorly crafted bill.
- The Opening Panel with presentations from Oregon Firearms Federation, NRA, Oregon Gun Owners, and NSSF in opposition were very well done.
- Oregon's gun owners brough solid data,
- CHL carriers some of the most lawful citizens we have and should not be the target of legislation: 7x less likely to be convicted of a felony than even police.
- When one removes public gun ownership criminals have a free path: 97% of mass shooting events happen in gun free zones where people cannot protect themselves.
- Proponents of the bill brought arguments of fear and less guns equals less crime, but not credible data.
- We should all be aligned that legislation needs to focus on criminals not our state's most lawful population.
- Unfortunately, the work session will continue to work 7 late amendments which only demonstrate the bill was flawed from the start.
UPDATE 2/16/21: SB554 is scheduled for Public Hearing on 2/22/2021 at 8 AM. SB554 enables local municipalities to independently adopt ordinances or policy on firearms. This would enable local governing bodies override the Constitution, Bill of Rights, and state law (removes current preemption). By allowing each community to be independent and different. Lawful citizens may unknowingly violate the law and risk criminal punishment just by traveling through a city or places like an airport.
